Question My 19 year old son went to open up his first checking account. The bank that he went to told him that he had been sent to Checksystems back in 2007 before he was even 18. We were shocked. Unbeknownst to him my exhusband (we were married at the time) opened up a minor checking account in his name and my son's name when my son was 13 back in 2003. My exhusband ran the account into the negative and the account closed and eventually was sent to a collection agency and Checksystems. How can my son be legally responsible for that when he didn't even know the account had been opened and he was only 13 at the time. Is it possible to get his name removed from CheckSystems? Is this going to show up on his credit report and if so can he get it removed?
Answer Hi Lori,
generally chexsystems doesn't report to the credit bureau, however it is possible that the bank did. I would file a fraud report, this can usually be done by filing an affidavit of fraud at the bank or you may have to file a police report. A minor cannot be a signer on a checking account and therefore cannot be legally held responsible for any activity on an account that had negative activity prior to his turning 18. Also, in order for him to be on account he would have had to have signed a consumer signature card. It sounds like this was reported in error, I would start with the bank, and if they arent much help, file a fraud report with your local police precinct.
