Question My brother is 20 years old now.He is in job corps so he isn't allowed to leave the property,under any circumstance.We meaning my brothers,my mother,and I all know my little brothers father is a lier and a thief.When my aunt was alive she left us(my brothers) a cd with our names on it and her's.Now my brother is 20 and was suppose to receive his at 18.When they did live in Florida my brother told me they had issues with makeing payment to payment,they were very short on money and all that.Now they live in montana.Miracoulusly his father got a piece of property and is able to build a log cabin on it.My brother and i think he took his money and used it to buy the property and the logs and everything else.My question is how can i get my little brother his money back.I called the banks they all said that the account was closed in 2004.Which i believe is when my aunt passed.Now when my brother called the banks the other day they told him that in 05 there was 30 grand with his name on it and now there is absolutely nothing on the cd or anything.My little brother has still to this day not seen any money or anything except for a check book with his name on it.From my experience with my cd the only time I got a check book with my name on it is when I took out my own money.His father said he put it on an account untill he turned 21,but when my little brother asked bout it they said they have no records of anything showing that he has it put away till then.So what can i do or my little brother do from here to find out where his money went?if you need more information or have any questions please let me know and thanks for your help
Answer this sounds like an internal family thing that may need an attorney? basically if she passed away regardless of who else's name was on it, if he was named beneficiary in her will and/or trust, he has every legal right withdraw all that cash regardless of anyone else's name. The bank may not show a record of the account because if he is telling the truth, he may have put it into an account in just his name, or they put him as "benficiary, non titled" which is very common, legally they cannot disclose anything about the acct, even its existence.
