Worker`s Compensation - can a previous injury be claimed again?

Expert: Margot RN BScN GNC - 1/22/2008

Question
My husband was injured 4 years ago on his job. I kneeled down to hook up a trailer as he does each nite and he tore the meniscus muscle in his knee. It was surgically repaired but with no guarantee it would last. In the last year he has had alot of pain and sometimes can hardly stand on his leg. If he were to return to the Dr and were to need furthur surgury would this be still covered by workmans copp. Thank You for your help.

Answer
Hi Fran and thanks for writing,

It would really depend on several things:

-was the original injury & surgery covered by WC?

-did your husband sign any type of waiver releasing them from any future claims related to that injury?

-and of course the specifics of the actual policy he’s covered by …

I hope this helps and I wish you all the best for you and your husband in 2008,

Margot
