Worker`s Compensation - fired while out on a workmans comp injury
Expert: James Saylor - 10/8/2008
Question I was burned on my hand at work and had to leave and go to the emergency room, I was treated and told I would not be able to work the next day. I reported this to a coordinating manager that same evening. The next day my store manager called me at home. He started the conversation by belittling my injury..I then told him the severity of my injury. He asked when I am scheduled to work again. After telling him he informed me that I was fired because I had dyed my hair with pink tips. Which I had done over a week ago and was keeping it under a hat so that nobody would notice. Can he legally fire me while I am out on injury?
Answer Yes he can, as sad as that is there is no reason required for termination. I would file for your unemployment as soon as you can and they should not have problem with your claim. Also make sure a work comp injury form was filed for your medical. Sorry for the bad news but that is Utah.
