Question
NJ workman compensation laws basically work like this, you get injured,you see a wc Dr. he decides when you can go back to work.You are paid for the time you are out of work. In many cases people that have been permanetly injured will suffer. While you are awaiting for a judgement, they take away your medical coverage, they stop paying you. There is no set time limit on how long these cases take, we are at the 4 year mark. We are homeless, my husband suffers with pain and cannot go to a Dr. The attorney has no control, these insurance companies keep delaying a court date or hide behind some other law that keeps them from settling the case all in hopes that the person who was injured will give in and settle at a less than fair offer. The name of this company by the was is AIG. My question is can you sue an insurance company for mistreatment or negligence. There are many people in NJ that are suffering due to these laws.

Answer
I'm not sure. I have never seen a company that can stop medical. Even a settlement still has a medical claws that normally states they will continue payment for medical. Other then the loss of motion settlement there is no other ratings that are used in Utah. If your attorney can not get the courts moving then maybe you need to talk to another attorney. As for the law suit if its the way you say then yes it does open the company to undue process. Seek a personal injury lawyer and a class action lawyer to see if they will do it or if they think its a negligence suit. If you would please let me know what happens.
