Question
hi a friend of mine got hurt at work. now after surgery and a few months they are telling him that he needs to come back to work otherwise he will no longer have his position. i thought if you got hurt on the job it doesn't matter how long you are out that the company has to hold your position for you. are they allowed to do this. mind you the boss said at one point that he would make arrangements for him to come back on light duty but since then changed his mind.

Answer
the company does not have to hold the job but if they fire him with out another possition and your friend has not been released from the doctors, then your friend is still paid. Its not advised to leave your friend with no job but there is not a law saying they have to hold your possition, and the way the law is writen in Utah is less then helpful.
