Question
I recently got hurt on the job, and I sprained my ankle.  I am being treated for my injury, and I have been put in the office on light duty.  I am worried about keeping my job.  I haven't done anything that I am not suppose to do.  I just actually started the job this month, and I already got injured.  I have been going to the Dr. appointments, and going to the office.  Calling the supervisor, etc.  I can't legally be fired can I and if I do get fired what are my rights?

Hi Heather,

It's not really that simple, you could still get let go within 3 months and they can legally say you just didn't pass your probation.  It also depends on the worker’s comp laws in our state as they do vary widely region to region but in most states there is no law preventing employers from letting people go after an on-the-job injury.

My suggestion is to keep doing the best job you can and do everything you are asked to do in regards to the injury and that’s really all you can do.  If the employer see’s that you are a valuable employee who was injured through no fault of your own, I’m sure they will keep you on.
