Question Over 15 years ago I suffered a work related back injury that required surgery. I was placed on perm. disability and a hearing was eventually held and the Work. Comp. judge decided I be awarded a monetary sum to be paid to me in increments over several years. In 2002 the total award was reached. I am over 65 and receive Soc. Security and Medicare. I have never used Medicare for continued treatment for my back over the years because in the initial settlement I was awarded all future medical care to my back to be taken care of for life by Work. Comp. Treatment has included infrequent epidural shots and prescriptions for pain medication. Work. Comp. Ins. carrier now is offering a reasonable sum to agree to a Compromise and Release Settlement. IF I AGREE WHAT MUST I BE AWARE OF AS TO HOW THIS MIGHT AFFECT MEDICARE SHOULD I NEED FURTHER TREATMENTS IN THE FUTURE? I should also mention I have an incurable ailment unrelated to the back injury and have not been given much time left.

Answer first im sorry for your ailment. Now okay as for your work comp settlement offer I would seek an attorney. Of course you have possible worsening of the injury but as you say you dont have alot of time. So a settlement may be a way to get them to pay for the injury and to take care of other bills or what ever you may seek. Now if you do need treatment medicare may say you have to pay the amount of settlement before they will touch it. This is the only problem I can see, but the time you have will determine if this is an important concern or not to you.
