Worker`s Compensation - denial letter

Expert: James Saylor - 9/21/2009

Question
I had been seeing a doctor for tendonitis since last year 07/08 (work related) because my job doctor stated he could not find anything wrong with me other than tendonitis after he did an Xray and performed an EMG test and gave me a wrist brace that I have been wearing for about a year now; so I requested to see another doctor and was allowed to.  The new doctor, as of 04/09, did a MRI came back negative so he sent me to have another EMG test which showed that I had muscle damage and carpal tunnel to my left hand and also carpal tunnel present in my right hand as well. As I returned to work on 09/21/09, I received an e-mail (a denial letter) from my claim's adjuster stating that this was a new claim for carpal tunnel and not for tendonitis and that I had been denied.  My adjuster stated that carpal tunnel could have occurred from anywhere other than my job.  I have been with this company for the past 9 1/2 years.  I use to do heavy typing and transcription work until my injury but now that I am on light duty I do a lot of data entry work and light typing.  Worker's Comp told me that I could pay for the surgery myself though my own insurance company because they will not pay for it. I am going to appeal this.

Answer
I would fight this, you did not say if this was in Ut, but in any state they will lose the claim and have to pay for the surgery. I would also seek an attorney as fast as possible. They will know if your due any damages as well as any other ways to get the work comp company to pay. Do not pay for any of it your self untill an attorney tells you that its okay. Or you could be out and just make a mess bigger.

Hope this helps.
