Question QUESTION: Can my employer prohibit me from performing light duty work, telling me that do light duty work exists...when in fact, light duty work is avaiable at my shop?
ANSWER: You'd have to confirm this with your adjuster, but I think it is the employer's choice.
Good luck,
Margot

QUESTION: My employer and clerical staff have made allegations that my work related injury happened on my own time. I have already corrected these falsehoods with an adjuster. My question: In your experience, if the employer goes deaf, dumb and blind to the employee at the first sign of a workman's comp claim, is it reasonable to assume that my position will be filled by the time I'm released by a doctor to return to work? Can I be laid off, let go or fired while waiting for workman's comp benefits and or recovering from surgery? Thank you.
Answer Hey Michael,
In most states it is perfectly legal for employer's to terminate employees after a Workman's Comp injury. If your employer has already accused you of fibbing then it sounds like they may not be too hones themselves or eager to have you return.
I hope it all works out for you. Remember that most things happen for a good reason, even if we can't see it at the time.
