Subject: Back Injury on the Job???

Question
Good Morning,

A girlfriend of mine hurt her back on the job two days ago.  She went to her immediate supervisor who said according to company policy she had 24 hours to file an injury report. He told her that if her back didn't feel better tomorrow, then she should fill out the injury report.

So the next day, the Head store manager returned after being away for a few days and told her that she should of filled out the injury report the day of the incident...and definitely before she left the premises.  He also directed her to immediately go to the workman's comp doctor in the local area.

She returned later that day with restrictions placed on her by the doctor (light duty...4-6 weeks).

She is and has been one of the most, if not the most popular and valuable employees at this particular store.

Her concern is that for some reason she is feeling guily for being in a light duty status and letting down her fellow employees.  Especially after hearing through the rumor mill that her visit to the WC doctor cost the company "X" of dollars.

Bottom Line is...do you have any advice on how she can protect herself if the situation turns against her?

Thanks so much!

Cheri

Answer
Well I have seen this before and have talked to others that have had it happen. I dont know if it is the company trying to stop us from going to the doctor or they are trying to pull the wool over our eyes.
Ok on to your problem there are none. You have 30 days i believe to file a work comp. claim. And as for what it cost the company I would not worry because if it cost more then a hundred dollars the insurance picks it up. Dont worry about company just your own health and the well being. I my self did not want to go when I broke my back so I do know how it feels. I would not worry about any more problems with this even if you have a follow up visit or more time is needed the employees should agree with the injured not the company. Also if where the injury happened needs to be fixed and has not then it should be reported to OSHA so it does not hurt another person.
Well I hope this helped and I hope your friend gets better. And again let your friend know that even if the injury is her fault it is still covered under work comp and she cannot be fired for the injury happening.
  Good luck James
