Question
Hi James,

I asked you a question before and you were helpful. I've been through WC issues for 7 years with shoulder and back problems (had back surgery and have received impairment ratings with limitations). At the last hearing, the WC carrier and my attorney decided to settle (called a Section 32 Settlement). Then the carrier sent me on a final IME. It came back acknowledging the issues are still present, but, as usual, the IME doctor said the shoulder disability is "mild" and the back "partial." Now the carrier requested a hearing to discuss suspending or reducing the payments. In your experience, why would they suddenly try to back out of the settlement? Don't IME doctors ALWAYS favor the carrier and try to minimize the disabilities? Thanks.

Well Im sorry for the problems you are having but it is part of there game. If they think you are not telling the truth or they have somthing they think can get them off the hook they will go for it. This is a insurance company remember and they dont like to pay out. You said you have a attorney that is good because they are working for there money to. As for your question about the doctor most of the time if Workers Compinsation send you to a doctor they know how that doctor rates things and that they will rate thing less then a independant doctor will. What you should do is ask your attorney if you can get another doctors oppinion about this. Now work comp does not have to pay for the doctor you go to unless you have not chosen a doctor of your own since the injury happened. If not then you can tell work comp that you are taking your case to your own doctor and they will handle it from there. If you do this i would suggest your family doctor and they can refer you out from there.

Again i am sorry for your pain and what ever you do dont give up on your rights and dont let workers compinsation off without paying there fair share.
