hello there

great site by the way

ok. i will get to the question..i have an on going claim with my back being reinjured at work.i am getting wages replaced right now from wcw. i hurt my back at work and when i went to my doctors she gave me a note for my boss to tell him i needed a week off of work. when i gave it to him he was mad and told me that he was going to lower my wage and put me to part time untill my back is fixed. that was the start of it all, i told him that i would be coverd under wcb and he said that i wouldn't be and didn't fill out any paper work. so i filled out all the paper work myself and i am coverd. so the next time i went in with anouther note from my doctor he through it on his desk and said that he would have to replace me again. the last note that i gave him from my doctor he through it on his desk and said that he wanted something differant from my doctor then these notes for more time off. i said like what..he said like an injury report. i told him that he should be getting all of the paper work that he needs from wcb..he said that i should just phone my doctor and tell her to phone him and he would tell her what he wanted. he said that he wanted this for his own personal file..i personally don't think he has the right to anything about my claim unless wcb is giving to him..am i correct?this is my question..what dose he have the right to ask me for concerning my claim that he wouldn't get from wcb..

Hi Kim and thanks for writing,

Laws do vary state to state for WCB so I always suggest people go online and check your local state regulations - but it does sound like your boss is being unnecessarily difficult and is probaby breaking the WCB regulations, but you also have to work with this person in the future so weigh the benefits of not providing him with whatever form he wants IF you are comfortbale doing so.

I'm not sure what he means by an "Injury Report", would that not be the form completed by you at work? Doctors usually charge for filling out forms and you would probably have to cover the costs. I would also suggest you call WCB and talk to their helpline and ask what your rights are and what support they can provide for you - ask if you can fax any future notes from your doctor to your boss so you don't have to deal with him in person, keeping things in writing is always a good idea and cc every correspondance to your WCB adjuster as this may help your boss to be less difficult.
