I was on this site back in Oct and asked a question about a workmans comp issue regarding my son and a back injury from work.( Nuero and company doctor did not agree with each other) well we took your advise and contacted a lawyer as my son was terminated from his job because he no longer could perform his duties.. not to mention the last appointment with the nureo surgeon was cancelled by the doctor because he refused to get involved in a legal case and the company refused to pay for next visit since their doctor said he was released and able to work..Lawyer we contacted and hired filed a partial disability claim with dept of labor against the company in hopes of forcing my son to be seen by another specialist chosen by dept of labor board. In the mean time, son is with out medical attention (still in Pain) no job, no insurance and becoming very depressed.. have not heard from dept of labor and lawyer telling us to just sit and wait for there response..How long can one wait..my son can not even get a job flipping burgers from the jobs posted at labor dept as they say he must be fully fit to perform any type of duty..I guess my question is: can he still apply for unemployment with a case pending with dept of labor for disability and if need be can he even accept a job if offered with light duties without jepordizing a disability claim... we are lost here in Tn and only want my sons health and life back to normal...at this point we are trying to put money aside for a check up with another specialist but yet i cant even seem to find anyone that will see him until we have money up front...what ever happened to the oath doctors once lived by... of course from what we have notice these last few weeks the lawyers and companies we all work for apparently have taken the same oath...thanks again for being there...your'e the best.

So sorry to hear about your son's continued challenges, insurance companies notoriously drag their feet as they know a lot of their claims will give up before they're settled as most people can't afford to wait forever - so many honest people with legitimate claims lose out this way - there's nothing fair about the system and the government doesn't seem to care (except to listen to the big money insurance lobbyists).
I'm afraid I can't advise about EI laws in Tn as I am not familiar with them, but you do ask good questions. I would suggest you make an appointment and go talk to someone at Unemployment and find out what your options are. Some places it's ok to collect EI while you're waiting for a disability claim, but laws and regulations vary state to state.
