Worker`s Compensation - Would this be unlawful termination?

Question
My husband broke his wrist on the job.  He had to have surgery to put screws in ligaments and pins in the bone.  He's been out of work for 11 weeks and will be out for at least another 4 to 8 weeks during physical therapy.  He is unable to use his hand and therefore is not able to work.  Last week his manager/supervisor told him that if he is out for 12 weeks he can be terminated.  Is this legal with a compensation case in New York State?  Can he legally be fired at the end of this week?  Should we contact a lawyer?

I looked up Comp Insurance in NY but the site was not too helpful. I would advise you to contact Advocate for Injured Workers at 1-800-580-6665 20 Park Street, Albany, NY 12207 for appropriate guidance and resources.
