Worker`s Compensation - work appeal

Expert: James Saylor - 9/8/2005

Question
I need more infomation on CA law for appeals for work injury. what to do do i need to go to a lawyer or not go to work what are my rights

Answer
Well Elizabeth each state has its own rules in Workers comp. but there is a good chance that you will probably want a lawyer. There are several reasons for this. First is they will talk to the other sides lawyer and then they also know what the court wants. The paper work for those is very confusing to say the least. So i would say take your case to a lawer. If you can work and the doctors have released you to work you should. If you were released but feel it is hurting you more return to your doctor and let them know. Maybe they can help or modify your work schedual to make things better. Also dont forget if you are seeing a doctor the company sent you to in most cases they work for your employer not you. So in some states you can change your doctor one time for each injury or case. So i would take it to your family doctor and he\she can refer you out as they see fit to.
Hope this helps and you get your appeal filed
P.S. the labor board our commision is in charge of how the appeal needs to be handled.
Good luck.
