Question My husband has worked in construction for 15 years without incident. Two weeks ago a worker dropped a two hundred pound peice of ductwork which hit my husband's arm. He suffered an exposed fracture, had to have emergency orthopedic surgery and was hospitalized for four days. He had a follow-up appt today and the Dr. said that my husband is allowed to go back to work as long as he doesn't "use his right arm at all". (He is right handed). He is not even in a hard cast at this point. If he even bumps into something he's back to square one. Now my husband's boss is saying that he doesn't want him to come back if he can't work. Does workman's comp cover us still, now that the Dr. said he could go back to work with restrictions? Is his boss required to let him come back to work? Any advice would be appreciated. Thanks
Answer Sorry to here about your husbands injury to his arm. But in Utah your in luck. If the doctor's release your husband to work with restrictions, and his company does not want him back until he can return to full duty he is covered. Work comp is still responsible, and should pay. I mention Utah because all states are different and each has its own rules. I have been working with Utah for a long time, and I can look into other states laws. But I can not say for sure in any other state. I hope this helps with your concerns and your husband gets better real quick.
